CNL.NY SMS/MMS Mobile Messaging Program Terms and Conditions

By opting into our mobile messaging program (the “Program”), you agree to the following terms and conditions:
User Opt-In
To participate in the Program, you must opt-in through forms on our website. Once you opt-in, you consent to receive SMS/MMS marketing messages at the phone number you provide. These messages may be marketing promotions and updates.
User Opt-Out
To stop receiving messages, simply reply with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. You may also receive a confirmation message of your opt-out request.
Duty to Notify Us of Changes
If you stop using the phone number associated with your opt-in, please opt-out before canceling, selling, or transferring your number. You’ll be responsible for any costs incurred if you do not notify us before the change.
Message Frequency and Costs
You will receive recurring messages, and message/data rates may apply. The frequency of messages depends on your interaction with us.
Program Description
The Program includes marketing messages about CNL.NY’s products, services, and promotions, both digital and physical.

For support, text HELP to the number you received messages from or email azima@cnlny.com. Please note: Email is not an opt-out method.
Dispute Resolution
In the event of a dispute, we agree to resolve the matter through binding arbitration (not court). This means you waive the right to a jury trial. Arbitration will be held in Bay Shore, NY.
Legal Compliance and Age Restriction
By participating, you confirm you are at least 13 years old. If you are under 18, you need parental permission.
Prohibited Content
You agree not to send any fraudulent or illegal content, including any harassing, obscene, or offensive messages.
Warranty Disclaimer
The Program is provided as-is. We are not liable for any delivery failures due to issues with your wireless carrier.
Miscellaneous
By participating, you confirm you have the right to enter into this agreement. If any part of this agreement is unenforceable, it doesn’t affect the rest of it.
